Overview

Association rules are not anything the prudent sportsman should be surprised by.   They begin with all must comply with all state and federal hunting regulations and continue through ethical sportsmanship conduct.  With our full disclosure policy the up-to-date rules are listed below in there entirety and are suitable for download.  It is our intent that all who apply for membership have in fact read this entire section.

Our rules are simple as we want your hunting experience to be.  Nothing we do detracts from the tranquility of a good hunt.


Mid America Hunting Association

Rules and Regulations 

Goal and Purpose of the Association.  Mid America Game Bird Association (MAGBA) was organized in 1965 to further the interests of hunting and fishing enthusiasts by making some of the mid west's finest land and water property available for sporting use. The Association (renamed Mid America Hunting Association) has the expressed purpose and responsibility of balancing the needs and requests of Members and Landowners alike. Its goal is to maintain that balance and continue to offer a variety of quality hunting and fishing facilities to its Members into the 21st Century.

I. Definitions:  
Association: Shall mean the "Mid-America Hunting Association"
Member: Shall mean any person or entity which has qualified for and has been accepted into membership in the Association.
Member's Family: Shall mean spouse and all single children and legal dependents who are dependent on member and who reside in his household.
Facilities: Shall mean all properties, facilities, services and activities which the Association offers or provides its members.
Management: Shall mean the Board of Directors of the Association and any duly elected officers or appointed officials of the Association.
Membership Materials: Shall mean all materials received from the Association and shall include without limitation all membership cards, vehicular identification stickers, maps and other materials contained in the Member's Manual or received from time to time, by mail or otherwise, from the Association.
Rules and Regulations: Shall mean all rules and regulations designated as such and all other requirements and instructions indicated on the individual property maps or otherwise set forth in materials contained in the Member's Manual or received from time to time, by mail or otherwise, at the discretion of the Association.

II. Membership Agreement and Acceptance:
All candidate members shall submit themselves to Association screening prior to signing the membership agreement.
Acceptance to Membership shall be based upon Association screening which includes a candidate Member's showing of a sound respect for private property, Conservation and the rights and interests of other Association Members.
The Association reserves the right as part of its initial screening process to request character references.
Information regarding applicant's race, color, religion and ethnic or national origin shall not be submitted to or considered by the Association for Membership.
Each candidate Member shall affix his name to the Membership Agreement and the Rules and Regulations of the Association with the understanding that compliance is mandatory and any such non-compliance is subject to financial penalty, suspension or termination of Membership rights.

III. Transfer of Membership 
Any Member, upon having paid his Initiation fee and dues, may make a request to the Association to effect a transfer of his membership. If the membership goals of the Association have been reached, and upon payment of a $100.00 transfer fee, such a membership may be transferred at the reasonable discretion of the Association. (Transfers are limited first two years of membership)
No Member may advertise or permit his membership to be advertised for transfer through any form of public media.

IV. Inactive Memberships  
Any Member, due to circumstances, i.e., transfer out of state, medical injury, etc., that wishes to maintain his membership status but will be unable to participate for a period of 12 months, may put his membership in an inactive status for a fee of $60.00. During this 12 month period of time, all Association privileges are suspended until full membership is reinstated. The member shall remain on the mailing list to keep pertinent information about the Association up to date.

V. Liability of Members  
Members of the Association, by acceptance of his membership, does hereby accept any and all liability for damages or charges for himself, his family or guests while using Association facilities. Each member shall be personally liable for any and all damages directly or indirectly caused by his negligence or omission or due to the negligence or omissions of his family or guests.

VI. Release of Liability: Indemnity of Association
Member acknowledges that he realizes that the facilities of the Association, may be dangerous and hazardous or may have dangerous or hazardous conditions which may or may not be evident, and Member assumes all risk to his person or property arising out of Member's use or observation thereof or participation therein, and Member releases and agrees to hold the Association and/or landowner harmless and indemnify it against any claims arising from injury, death or damage to Member, Member's family or guest, or his property arising out of Member's use or observation thereof or participation therein. Member also agrees to reimburse the Association for any attorney fees that said Member may cause the Association by making claim or suit against the Association.

VII. Payment of Dues 
All dues and other indebtedness owed to the Association shall become due and payable on such terms and under such conditions as the Management shall determine to its discretion. Any Member who fails to pay any dues or other indebtedness owed to the Association by the notified statement date shall be automatically suspended from use of the Association facilities until such debt is collected by the Association.
Any Member who remains delinquent after 30 days from the notified statement date may be cancelled from the Association by action of the Management.

VIII. Disciplinary Action: Suspension, Expulsion, and Reinstatement  
Management reserves the right to reprimand, suspend or expel any member, or take such other action as Management, in its sole discretion, deems appropriate to promote the quality and integrity of the Association and to enforce all applicable Rules and Regulations. Such action may be taken with respect to anyone who Management, in its sole discretion, believes has violated any expressed provision or amendment of the Association Rules and Regulations, including without limitation any requirement or instruction found in the Member's manual, on the relevant maps, or indicated from time to time by the Association in mailings or otherwise. All Members, Member's family and their guests must comply with all applicable Federal and State laws and refrain from conduct unbecoming of a gentleman or sportsman. Anyone who is suspended or expelled, or against whom action is otherwise taken, shall forfeit all fees, dues and other monies paid to the Association. The terms and conditions of reinstatement of Members shall be In addition to all penalties and legal remedies which may be applicable, any Member which Management finds has (1) loaned or otherwise allowed another to use his membership card or vehicular identification, (2) has in any way used, disclosed or distributed the Association maps or other Membership Materials other than solely for Member's personal recreational purposes, or (3) has taken game in violation of applicable Federal or State laws, shall, subject to Management's sole discretion, be personally liable to the Association in the amount of $100. In addition, any Member who has violated the above provisions shall personally subject himself to a fine of $500 per deer, $250 per turkey and $50 per any other bird or animal taken by use of such Member or any such other person who entered Association property by means of such Member's card or vehicular identification, or as a partial consequence of such Member's disclosure or distribution of such maps or other Membership Materials.
In the event of Membership expulsion, Members are required to return all Association Maps, Materials, Vehicular Stickers and Membership Cards to Management within 15 days of the expulsion. Failure to comply with this provision shall be deemed a violation of the Membership Agreement. Such violations shall subject Member to legal action by the Association which may include monetary damages.
Any Member against whom the Association successfully obtains a legal judgment shall reimburse the Association for all related expenses including Attorney fees and Court costs.

IX. General Rules
MANAGEMENT RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CREATE AND AMEND ASSOCIATION RULES AND REGULATIONS DESIGNED TO FURTHER THE INTERESTS OF THE ASSOCIATION AND ITS FACILITIES. IN ADDITION TO REMEDIES PROVIDED BY LAW, VIOLATIONS OF THE RULES AND REGULATIONS SHALL BE CAUSE FOR MEMBER'S REPRIMAND, SUSPENSION OR EXPULSION INCLUDING BUT NOT LIMITED TO MONETARY DAMAGES.
1. Each Member, Member's Family and Member's Guest shall comply with all Federal, State and local game and gun laws.
2. Reservations are required on all Association Facilities at all times (refer to reservation policies in section XI).
3. Members are allowed limited guest privileges only when complying with guest policy and procedure (See section X).
4. Membership cards, vehicular identification stickers, maps and all other Membership Materials, will remain the sole and private property of the Association. Such materials are solely for the Member's personal recreational purpose and are not to be otherwise used, duplicated or distributed in any way.
5. No Member shall loan or otherwise allow any person to use his Membership card, vehicular stickers, maps or other Membership Materials. All persons on Association property must show their Membership card and at least one other piece of acceptable identification when asked by property owners, law enforcement authorities, Management or other Members. Members (as well as the property owners from whom land is leased) are encouraged to report the names, vehicle license numbers, and all other relevant information, regarding any persons they find or believe may inappropriately be utilizing Association property.
6. Each Member, Member's family and Guest shall conduct himself in an orderly and sportsmanlike manner. No Member, Member's family or Guest shall become intoxicated while on Association Facilities.
7. Member's children under the age of 16 must be accompanied by an adult Member on Association Facilities.
8. Members will notify the Association headquarters in writing of any change in address and vehicular license plate changes.
9. Family Members are not allowed to use Association facilities without the sponsor Member's presence. (This ONLY applies to Members who have Family Memberships)
10. PARK AND WALK: Do NOT drive vehicles into or across Association facilities. ATV's are to be approved by Management prior to each use.
11. Waste: All trash shall be properly removed from Association Facilities. This INCLUDES any game which has been cleaned on Facilities.
12. No member shall acquire or negotiate to acquire the recreational rights, including hunting, fishing or camping, from property owners currently leasing to the Association except as authorized or directed in writing by Management. Any such unauthorized attempt shall result in immediate expulsion from the Association. Should any Member or former Member within one (1) year of Membership termination succeed in the acquisition of the above said recreational rights, he is expressly subject to section X of the Association Rules and Regulations.
13.  A maximum of two dogs per member allowed on association property at any time.   Guest passes do not apply to increase the number of dogs.  Members may have as many dogs in their vehicle as they desire.

X. Liquidated Damages:  
In accordance with RSMO section 400.2-718, any Member or former Member within one (1) year of Membership termination who willfully violates section IX(9) of the Association Rules and Regulations shall be considered in breach of contract and liable for liquidated damages to the Association. The liquidated damages are strictly designed to protect the interests of the Association and all of its Members. The liquidated damages are not agreed upon to serve as a penalty to Members or former Members within one(1) year of Membership termination.
Liquidated damages shall be calculated based on the following considerations:
1. Any reasonable costs related to but not limited to the acquisition of "equally beneficial recreational property." Such costs include reasonable fees for Management's time spent investigating and acquiring the new property. Such costs also include any transactional or attorney fees related to the new transaction.
2. If the cost of acquiring "equally beneficial recreational property" exceeds the lost property's lease value, the Member or former Member is liable for the difference in cost.
3. "Equally beneficial recreational property" shall be reasonably determined by the type of recreational use of the property, the quality of wildlife on the property, and the acreage of the property. If the lost property included Association enrichment such as crop improvement, the creation of flooding capability or land adjustment, then such enrichment shall be added to the cost of obtaining "equally beneficial recreational property."

XI. Guest Policy and Procedure 
The Association is operated for Members only. We must plan for those times when hunting pressures, land costs and availability of quality properties may necessitate revision in guest regulation. The number of guests authorized to use Facilities will reviewed periodically. Current listed guest policies are as follows:
A. Daily Guest Pass
1) Guests are not allowed on opening day and opening weekend of any season.
2) All guests must be paid for and registered by name and address in advance.
3) The same person may not be taken as a daily guest more than 4 times per season.
4) Members will be allowed to purchase a total of 6 daily hunting passes per season.
5) Members will be allowed to take a maximum of one guest per day quail and pheasant hunting and no more than 2 guests per party regardless the number of members in that party.
6) Waterfowl guest reservations for weekends will not be taken until after 12:00 Friday.
7) Deer and turkey are by special permission only after opening day and opening weekend.
8) Inactive and canceled members will not be allowed as guests.
9) Daily guest reservations will be accepted only when Members are not utilizing a facility to its pre-assigned limit.
B. Fishing, Camping and Small Game Policy. Each Member is allowed 5 free fishing and small game (rabbit, squirrel, dove only) daily passes per season.
C. No Guests may ever use an Association Facility without an accompanying Member. Guests are not allowed on opening day or opening Weekend of any season.

XII. Reservations Policy and Procedure
In order for the Association to provide the best service to its Members, there is a required reservation system. The system assures no overcrowding, proper land utilization, proper game and fish management and provides Members with up to date information on the property of his choice. In simple words, our Association cannot realize these goals without it.
RESERVATIONS ARE ON A FIRST COME FIRST SERVE BASIS.
HOW-WHEN- AND WHERE?
1. Call the office (816)761-3636-Ask for "reservations"-. Hours are generally 9:00-5:00 Monday through Friday, and on Saturday morning during the active hunting season.
2. Give your name, request the property that you intend to use and the dates you will use it.
3. You may call up to 30 days prior to any season date.
4. Reservations must be canceled if you do not intend to use the property. There is a penalty of suspension for non-compliance.

XIII. Waterfowl Rules and Regulations
Waterfowl hunting from blinds requires a high degree of communication
between individual hunters in the blind and between different blinds. Listed below are some of the rules that all experienced waterfowlers know, but we are restating them for everyone. Some of these are so important that any violation will result in a Member being asked not to come back to the property again. At controlled blinds your actions may affect many, not just yourself.
SKYBUSTING
Is the capital crime of waterfowl hunting. To even load a shotgun without knowing its effective range is a serious mistake. Respect for this rule is the difference between hunting success or failure in your blind and others close by. This is important not only to avoid crippling birds which are out of effective range, but also in honoring the flight pattern to another blind. The official policy is: "When in doubt, don't."
GENERAL WATERFOWL RULES AND REGULATIONS
1. Each hunter is allowed only one gun loaded or unloaded in a blind.
2. Keep guns on safety at all times while in the blind.
3. Keep you dog on a leash if you are hunting with other Members in a blind. Also, inform the office at the time each reservation is made if you are bringing a dog into the blind.
4. Do not bounce from lease to lease unless approved by the office.
5. Park at designated parking areas only. (on the map) Vehicles should always be parked at least 200 yards from the blinds.
6. When roads are wet, park and walk to avoid rutting of roads.
7. Floodwater is extremely hazardous! Each hunter should verify existing water-flood conditions and conduct his hunt as conditions require. Each hunter should be aware of the possibility that water levels can rapidly change.
8. Honor the other man's call. Do not pass shoot ducks or geese working adjoining blinds.
9. Never shoot into decoys. Let cripples get out of decoys before shooting. (DECOYS COST MONEY)
10. Waterfowl leases are for waterfowl hunting ONLY. No other hunting is permitted on waterfowl leases unless approved by the office.
11. Do not tear down cover from blinds: "If you can't see out, then ducks and geese cannot see in."
12. Do not leave trash and soda cans in blinds.
13. Decoys are to be brought in after every hunt. (This prevents people from stealing decoys and lets the ducks get a fresh view)
WATERFOWL HUNTING COURTESY 
Flying waterfowl have far better perception than we realize. They do not have to be in range to detect the slightest movement or contrasting color. Proper attire and movement control are absolutely necessary. Also, there are certain times which are sacred: the most important is morning shooting time until flight activity subsides. So if you are going to hunt, be there on time. If you are not on time, stay away from the blind if there are other hunters present until early morning activity has ceased. If you find yourself hunting with an inexperienced waterfowler whose actions are disturbing, feel free to inform him. Above all, waterfowl hunting requires RESPECT. Respect for the game (know your bird identification), respect for the other hunters (honor the other man's call), respect for firearms and respect for the landowner.
